Terms and Conditions (AGB)

These Terms and Conditions apply to all purchases made via the website of Sezai Citak (art@sezaicitak.com, Arnulfstraße 143, Germany).

They govern the relationship between the seller and the customer in connection with the purchase of artworks and related services.

 

 

2. Conclusion of Contract

 

 

The presentation of artworks on this website does not constitute a legally binding offer but an invitation to place an order.

By completing the checkout process, you submit a binding order.

A binding purchase agreement is concluded when you receive an order confirmation by email.

 

 

3. Prices and Payment Terms

 

 

All prices are stated in Euros (€) and include applicable VAT unless otherwise specified.

Shipping costs are added during checkout and shown separately.

Payments must be made in advance via the offered payment methods (e.g., PayPal, credit card).

 

Ownership of the artwork remains with the seller until full payment has been received.

 

 

4. Delivery and Shipping

 

 

Artworks are shipped worldwide unless otherwise stated.

Shipping times are provided for guidance only and may vary depending on destination and carrier.

Any import duties, customs fees, or taxes are the responsibility of the buyer.

 

The risk of accidental loss or damage passes to the buyer upon handover to the shipping carrier.

 

 

5. Right of Withdrawal

 

 

Consumers have the right to withdraw from a purchase within 14 days, in accordance with the statutory provisions, unless the artwork is custom-made or personalized based on customer specifications.

6. Copyright and Usage Rights

 

 

All artworks remain the intellectual property of Sezai Citak.

The buyer acquires ownership of the physical artwork but not any rights to reproduce, distribute, or publicly display the artwork without prior written consent.

 

 

7. Liability

 

 

The seller is liable for intent and gross negligence in accordance with statutory provisions.

For slight negligence, the seller is only liable for damages resulting from injury to life, body, or health, or for breaches of essential contractual obligations (cardinal obligations).

 

 

8. Applicable Law and Jurisdiction

 

 

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

 

If the customer is a merchant, the exclusive place of jurisdiction is the seller’s registered office.

 

 

9. Final Provisions

 

 

If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected.

In place of the invalid provision, the relevant statutory regulations shall apply.
